Pepperdine Wins 2009 FDI Moot Competition  

 

On Saturday 24 October 2009, before a tribunal composed of Prof. Dr. Karl-Heinz Böckstiegel, Prof. Martin Hunter and Mr. James Hosking, Pepperdine University Law School prevailed over St Petersburg State University to win the 2009 Skadden, Arps FDI Moot final. The other semi-finalists were Kings College London and the University of Belgrade. The best counter-memorial was submitted by Murdoch University School of Law, and the best memorial for claimant was submitted by Kings College, which was also the overall highest ranked team (memorials and preliminary oral rounds). The 2009 Thomas Waelde Advocacy Prize was shared by three winners: Aaron Echols of Pepperdine, Otylia Babiak of Suffolk University Law School and Marija Skundric of Belgrade University.

The problem - in part inspired by the editors of the recent TDM Special Issue on IP - involved questions of nationality, investment definition, MFN, compulsory licensing and expropriation and the relationship between investment law and trade law (TRIPs). 

The 2009 FDI Moot was hosted by the Deutsche Institution for Schiedgerichtsbarkeit (DIS) at the FIAC, Chamber of Commerce and Industry Frankfurt/Main 22-24 October 2009 and organised by the Center for International Legal Studies. My co-director, Chris Gibson (Suffolk University), and I would like to thank all our partners (especially DIS Secretary General Jens Bredow and Mr. Peter Kraft) and all our sponsors (Skadden, OUP, The Chartered Institute of Arbitrators, the Frankfurt Arbitration Circle, TDM) and above all the teams, the arbitrators, and the tribunal secretaries (Düsseldorf Jessup team, young colleagues from the Frankfurt law firms) for their hard work and just being there to make it such a fun event.
